Vitura / Your information

Privacy Policy

Effective date:

This policy describes personal information collected through Vitura’s pre-launch website, early-access signups, sample program, feedback, and investor inquiries. It explains our current practices and how to contact us about your information.

01Who we are

Vitura, Labs by ATPeak, LLC., registered in Delaware, United States, operates Vitura ("Vitura," "we," "us," or "our"). Our business mailing address is 1002 NW 36th St #1005, Miami, FL 33127, United States. Our privacy contact is hello@takevitura.com.

For activities in which we determine why and how personal information is processed, we are the responsible business or data controller under applicable privacy law. This policy covers our current pre-launch activities; we are not presently selling products through the public pre-launch program.

02Information we collect

We receive information you enter on the website or give our team by email, text, or another conversation. Our team may enter details you previously provided to coordinate a sample. Someone acting on your behalf may also provide your details; please only provide another person’s information when authorized.

Sample requests require a name, mailing address, and either an email address or phone number. Feedback requires a name, comments, and either contact method, but not a mailing address. Both contact methods may be provided.

  • Contact and address information. Names, email addresses, phone numbers, postal codes, mailing addresses, and any delivery details you provide.
  • Sample and fulfillment records. Requested bottle quantities, sharing preferences, request/shipping/feedback status, related dates, and shipment or tracking details recorded by our team.
  • Feedback and correspondence. Product experiences, questions, messages, and other information you choose to provide.
  • Early-access and communication preferences. Signup source, selected email/SMS preferences, opt-in and opt-out records, and optional date of birth when supplied for birthday communications.
  • Investor inquiries. Contact information and any firm, investor type, investment range, or message you provide.
  • Browsing and technical information. Limited page-view information and a randomly generated browser-session identifier through default-on analytics, unless you opt out or your browser sends Global Privacy Control. Website and service-provider connections also involve technical network information such as IP addresses. Our analytics events exclude form content, query strings, URL fragments, referral details, and contact information.
  • Storefront-preview information. If you access a storefront preview, cart choices and cart identifiers may be processed by the site and Shopify. Our sample forms do not collect payment-card information or purchase history, and the pre-launch sample program does not require a purchase.

03How we use information

  • Samples and delivery. Respond to sample requests, coordinate fulfillment, provide sample or delivery updates, and follow up about your experience.
  • Request and feedback matching. Connect a request with feedback using a matching email, phone number, or existing unambiguous contact profile. Feedback can be submitted without a prior sample request.
  • Product development and support. Understand submitted experiences, improve products, answer questions, and address product or safety concerns.
  • Early access and business communications. Manage early-access records, respond to investor inquiries, and use the communication preferences submitted through the relevant forms.
  • Website operation. Operate the website, maintain cart functionality where used, understand site usage, and investigate technical issues or misuse.
  • Legal and administrative purposes. Maintain relevant records, address disputes, and respond to applicable legal requirements.

Providing a phone number or email address for a sample request or feedback does not, by itself, subscribe you to promotional messages. These submissions do not grant new email or SMS marketing consent and do not cancel an existing subscription you separately requested.

Automated sample-status updates organize records; the sample forms do not make solely automated decisions producing legal or similarly significant effects on you.

04Service providers and disclosures

Relevant information is processed through providers that support the website and sample program. These include:

  • Klaviyo. Contact management, early-access and investor records, sample-request and feedback lists, communication preferences, status organization, and related communications. Being on a sample-request list is not marketing consent.
  • Google Maps/Places. US address suggestions. When you type into the enabled address-search field, address queries and technical information may be transmitted to Google before you select a suggestion. Address details can also be entered manually.
  • PostHog and website-platform services. PostHog provides page-view analytics that is on by default, with an opt-out in Cookie settings. Session replay and automatic form, click, console, and network-content capture are disabled in our website integration. Website-platform services also support hosting and operation.
  • Shopify. Connected storefront-preview and cart functionality where accessed.
  • Hosting and other operational providers. Website hosting, database storage, content delivery, website assets, communications, and sample delivery or fulfillment.

Information may also be disclosed to advisers, authorities, or other recipients when required by law, relevant to protecting rights or safety, or necessary in connection with a business transaction, subject to applicable law. We may disclose information to other recipients you authorize.

Providers may separately process information for purposes explained in their own privacy notices.

05Mobile information and text-message consent

We will not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent are excluded from disclosures for independent third-party or affiliate use. We do not sell this information or provide it for another party’s marketing.

This restriction does not prevent necessary processing by contracted service providers solely on our behalf to deliver authorized communications, administer consent and opt-outs, or provide related support. It does not authorize those providers to use the information for their own marketing or promotional purposes. Disclosures specifically required by law may also occur.

06Cookies and optional analytics

Essential browser storage supports site operation, cart identifiers where the storefront preview is used, and remembering your analytics choice. An opt-out is remembered in this browser unless its preference storage is cleared or you turn analytics back on. If your browser prevents us from reading your preference storage, analytics remains off.

PostHog page-view analytics is on by default; we do not display an automatic cookie-consent popup. You can turn it off through Cookie settings in the footer. Our integration sends limited page views with a randomly generated session identifier kept in memory, rather than a persistent analytics identity. It excludes sample-request, feedback, investor, account, checkout, and legal pages. Page-view events do not include form values, query strings, URL fragments, or referral details. Like other internet services, the analytics provider receives technical network information when a request is made.

Session replay is disabled. Our integration also disables automatic click, form, console, and network-content capture. These controls do not prevent processing of details you intentionally submit through a form by the application and its service providers, as described elsewhere in this policy.

You can turn analytics off or back on through Cookie settings in the footer. Turning it off does not restrict access to the site or its forms. An opt-out stops subsequent analytics capture and removes accessible PostHog storage in this browser; it does not erase information previously received by providers. Global Privacy Control, when enabled in your browser, keeps analytics off even if you previously turned it on. Your choice applies to this browser, not automatically to other devices. Default-on analytics is not treated as a record that you gave consent.

You can also manage cookies and local storage using browser settings. Blocking essential storage may affect site functionality and does not stop hosting, address-suggestion, or form-submission requests. Hosting and network-delivery providers may separately process connection and performance information when delivering the website. Cookie settings controls our PostHog integration, not all service-provider processing.

We do not currently use tracking pixels from social-media platforms, including Meta/Facebook, Instagram, or TikTok. This does not mean the website has no analytics, cookies, or technical data collection.

07Communications and your choices

Early-access and investor forms record the communication choices submitted with those forms. Review those choices before submitting. Sample-request and feedback forms are separate: their contact details are used for sample coordination and experience follow-up, not to create new marketing subscriptions.

Marketing communications, where offered and authorized, may include launch announcements, product information, offers, or birthday communications. Sample or delivery updates and replies to your questions are distinct from promotional messages.

To stop optional sample follow-up or request a change to your communication preferences, contact hello@takevitura.com. Marketing emails may provide an unsubscribe link; for text messages, follow any opt-out instructions included in the message or contact us. Providing another person’s sample details does not authorize marketing to that person.

08Retention

Personal information is stored in our application database and relevant provider systems. The sample-request and feedback application currently does not apply a fixed automatic deletion schedule. This policy does not promise deletion after a set number of days or months.

Retention depends on the purpose, outstanding sample or support requests, communication preferences, product-safety or legal requirements, and relevant provider settings. Information associated with a dispute, investigation, legal requirement, or unsubscribe/suppression record may need to be retained. Provider and backup systems may have separate retention settings.

You can request information about retention or request deletion by emailing hello@takevitura.com. A deletion request is subject to applicable law, identity verification, relevant exceptions, and the systems involved; it is not an instant or automatic deletion instruction.

09International processing and legal bases

Vitura is based in the United States. Information may be processed in the United States and other countries where providers operate. Privacy laws in those locations may differ from the laws where you live. Contact hello@takevitura.com for information about relevant recipients and transfer arrangements.

Where EU or UK data-protection law applies, a lawful basis is required for processing. Depending on the activity, this may include consent where obtained, legitimate interests in responding to requested samples and inquiries or operating and safeguarding the website, or applicable legal obligations. Our interests do not override rights protected by applicable law. Additional requirements may apply to sensitive information.

Providing information is generally voluntary, but we may be unable to fulfill a sample request or respond if necessary contact or delivery details are missing. This privacy policy does not itself obtain your consent or waive your rights.

10Your privacy rights and requests

Depending on your location, the law’s applicability, and relevant exceptions, you may have rights to know about or access information, obtain a portable copy, correct inaccuracies, request deletion, restrict or object to processing, or withdraw consent. Some laws also provide rights concerning sale, sharing, targeted advertising, sensitive information, certain profiling, appeals, and freedom from unlawful discrimination.

Send requests to hello@takevitura.com with the subject Privacy Request. Include the email or phone used with Vitura and describe what you are requesting. Do not send unnecessary identity documents or health information. We may need to verify identity or an agent’s authority; requests and any response obligations are governed by applicable law.

You can ask us to reconsider a decision by replying to it or using Privacy Appeal as the email subject. You may also complain to an applicable regulator, including your EEA data-protection authority, the UK Information Commissioner’s Office, or a relevant US state regulator. You do not have to contact us first before exercising a right to complain.

11Sensitive information, age, and security

Our feedback form accepts free-text product experiences. We do not need medical records, diagnoses, medication lists, or detailed wearable measurements for ordinary feedback; please avoid sending unnecessary sensitive information. Submitted comments about health or well-being may receive additional protection under applicable law. Mentioning WHOOP, Oura, or Garmin on our pages does not connect the website to your wearable account.

The website does not automatically verify a visitor’s age. If you believe a child has provided personal information, contact hello@takevitura.com so the circumstances can be reviewed.

Information is handled through the application and its providers. No internet transmission or storage system can be guaranteed completely secure. Contact us if you have a concern about the handling of your information.

12Changes and contact

We may update this notice as our activities or practices change. The effective date identifies the stated effective version; it does not mean the notice was first published on that date. A policy update does not itself authorize a new use of information or replace any consent or notice required by law.

For privacy questions or requests, email hello@takevitura.com or write to Vitura, Labs by ATPeak, LLC., 1002 NW 36th St #1005, Miami, FL 33127, United States.
